1. Acceptance of Terms

By accessing or using WeedBates and PatientEA services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

WeedBates provides a digital wallet platform and payment coordination services for cannabis-related transactions in legal jurisdictions. PatientEA coordinates access to medical cannabis card services through licensed telehealth providers.

We are not:

• A licensed medical provider or telehealth platform (we coordinate access to licensed providers)
• A bank or financial institution (wallet credits are promotional, not deposit accounts)
• Providing legal or medical advice
• A cannabis retailer or dispensary

3. Eligibility

You must be at least 18 years old (or 21 in certain jurisdictions) to use our Services. By using our Services, you represent and warrant that:

• You are of legal age in your jurisdiction
• You are using the Services in compliance with all applicable local, state, and federal laws
• You have the legal capacity to enter into these Terms

4. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Cashback Program Rules

WeedBates operates a receipt-scanning cashback program:

• Consumers scan dispensary receipts to earn rebates funded by participating brands
• Rebates are credited to your WeedBates wallet upon receipt verification
• Cash out is available via Venmo, CashApp, or Zelle (minimum $5.00)
• Fraudulent receipts, duplicate submissions, or tampering will result in account termination
• We reserve the right to hold, review, or reverse credits suspected of fraud

6. Location Tracking

With your consent during signup, WeedBates may access your device's location to:

• Show nearby dispensary deals and store information
• Verify receipt authenticity by proximity to dispensary locations
• Provide anonymized, aggregated visit analytics to participating brands

You may revoke location consent at any time through your device settings. Revoking location access may limit access to location-based features.

7. Promotional Communications

By creating an account, you consent to receive communications including:

• SMS notifications about new offers and cashback earnings
• Email updates about new WeedBates, account activity, and promotions
• Push notifications about nearby deals and expiring offers

You may opt out of promotional communications at any time by contacting support or adjusting notification settings in your profile. Service-related messages (password resets, account security) cannot be opted out of.

8. Third-Party Data Sharing with Brands

WeedBates shares anonymized, aggregated data with participating brands, including:

• Total redemption counts and conversion rates for their offers
• Aggregated demographic and geographic insights (no individual identification)
• Product category trends and purchase frequency analytics

We never share your name, email, phone number, or other personally identifiable information with brands without your explicit additional consent.

9. Wallet Credits & Payments

WeedBates Wallet:

• Wallet credits are promotional rewards, not legal tender or stored value
• Credits have no cash value and are not redeemable for cash
• Credits may be used only for eligible transactions within our platform
• We reserve the right to expire, modify, or revoke credits at any time
• Credits are non-transferable except where required by law

Payments:

• Payments are processed by third-party payment processors (e.g., Stripe)
• You authorize us to charge your payment method for Services
• All sales are final unless otherwise stated
• Refunds are subject to our refund policy

6. Referral Program

Our referral program ("Invite & Earn") is governed by separate Referral Program Terms. Key points:

• Referral rewards are promotional wallet credits
• Self-referrals and fraud are prohibited
• We may modify or terminate the program at any time
• Participation does not create an employment or contractor relationship

7. Prohibited Uses

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or interfere with Services
• Engage in fraudulent activity or abuse referral programs
• Create multiple accounts to circumvent restrictions
• Use Services in jurisdictions where cannabis is illegal
• Reverse engineer, decompile, or attempt to extract source code
• Scrape, harvest, or collect data from Services without permission

8. Medical Card Services

PatientEA coordinates access to licensed telehealth providers for medical cannabis card evaluations.

• Medical evaluations are conducted by independent licensed healthcare providers
• We do not guarantee approval for a medical cannabis card
• Providers make independent medical decisions
• You are responsible for compliance with your jurisdiction's regulations

9. Privacy & Data

Your use of Services is also governed by our Privacy Policy. We collect, use, and protect your data as described therein.

10. Intellectual Property

All content, trademarks, logos, and intellectual property related to the Services are owned by WeedBates / PatientEA or licensed to us. You may not use our intellectual property without prior written permission.

11. Disclaimers

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

• We do not guarantee uninterrupted or error-free operation
• We are not liable for third-party content or services
• We do not provide medical, legal, or financial advice
• Cannabis laws vary by jurisdiction - you are responsible for compliance

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEEDBATES / PATIENTEA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF SERVICES.

Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless WeedBates / PatientEA, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of third-party rights
• Your use of the Services

14. Dispute Resolution

Arbitration: Any disputes arising from these Terms or Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.

Governing Law: These Terms are governed by the laws of the United States and the state where our company is registered, without regard to conflict of laws principles.

15. Modifications to Terms

We may modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of Services after changes constitutes acceptance of the modified Terms.

16. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• At our discretion for any other reason

Upon termination, your right to use Services immediately ceases.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Referral Terms, constitute the entire agreement between you and WeedBates / PatientEA.
